This website is operated by STARKTRACE LABS PTY LTD (ACN 697 835 206), an Australian company trading as Starktrace Labs (“we”, “us” or “our”).

By using this website, you agree to these terms. If you do not agree, please stop using the website. These terms cover website use; any products, services, deliverables and support we supply may be governed by a separate agreement. That agreement prevails to the extent of any inconsistency relating to that supply, subject to applicable law.

Website content is provided for general information about our business and capabilities. It is not legal, financial, engineering, safety or other professional advice, and should not be relied on as a substitute for advice specific to your circumstances.

Descriptions, examples, performance statements and research material are illustrative unless expressly agreed in writing. They are not a binding offer or a guarantee of availability, suitability or a particular outcome. Seek appropriate advice and independently assess suitability before making decisions or using technology in a critical system.

3. Acceptable use

You must use this website lawfully and respect the rights of others. You must not introduce malicious code, attempt unauthorised access, disrupt the website or its security, misuse contact forms, or use website content in a way that infringes intellectual property or privacy rights.

Unless otherwise stated, the website design, text, graphics, logos and other content are owned by or licensed to us and are protected by intellectual property laws.

You may view, download and print content for personal use or internal business reference, retaining ownership notices. No right to use our trade marks or branding is granted.

Subject to section 7 and to the extent permitted by law, the website is provided “as is” and “as available”, without warranties as to accuracy, completeness, fitness for a particular purpose, uninterrupted access or freedom from harmful components.

We may update content or interrupt access for maintenance, security or operational reasons. Take reasonable precautions to protect your devices and data.

7. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted or modified.

If we supply goods or services to you as a consumer, you may be entitled to remedies such as repair, replacement, refund, cancellation or compensation, depending on the circumstances and the applicable law. These statutory rights apply regardless of any website disclaimer or separate warranty.

Subject to section 7 and to the extent permitted by law, we exclude liability for loss or damage arising from your use of, or inability to use, this website or reliance on its general information, including loss of data, profits or business opportunities.

Submitting an enquiry does not create a client relationship, a service agreement or a commitment to undertake work. Please provide only the information needed to address your enquiry and do not send passwords or other sensitive material through website forms or ordinary email.

10. Privacy

This privacy notice explains how STARKTRACE LABS PTY LTD handles personal information collected through this website and related enquiries or support requests. Where applicable, we comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. A separate privacy notice may apply to a particular product or service.

Information we collect

When you use our contact form, we collect your name, email address and project brief. When you email us, we also receive the information and attachments you choose to provide, which may include your organisation, product details and support history. We generally collect this information directly from you.

Our website and infrastructure providers may process technical information such as your IP address, browser and device details, requested pages and access times for delivery, diagnostics and security. The contact form uses your IP address to limit repeated submissions and includes it with the enquiry sent to our team. Enquiry details may also be recorded in diagnostic logs if email delivery is not configured.

You can browse without submitting an enquiry. If you do not provide the contact details or information needed to investigate a request, we may be unable to respond or assist. Please only provide personal information about another person if you are authorised to do so, and avoid sending sensitive information.

How we use and disclose information

We use personal information to respond to enquiries, assess potential projects, provide and administer services or support, investigate complaints, maintain security and meet legal obligations.

Information may be disclosed to personnel and service providers who need it for these purposes, including hosting, email, IT support and professional advisers. We may also disclose information where required or authorised by law. Sending an enquiry does not subscribe you to a marketing mailing list.

Hosting, external services and overseas processing

The website uses Microsoft Azure hosting and Azure Communication Services to deliver contact form emails when configured. It also loads fonts from Google Fonts and a JavaScript library from jsDelivr. Your browser connects to these providers, which may receive your IP address and technical request information and handle it under their own privacy practices.

These providers operate internationally, so information may be processed or stored outside Australia. Locations depend on the service and its configuration; we do not promise that information remains in Australia. Contact us if you need details about overseas handling relevant to your enquiry or service. Where Australian privacy law applies, we take the steps it requires in relation to overseas disclosures.

Cookies and analytics

The website's own code does not set cookies or use advertising or analytics trackers. Infrastructure and external service providers may process request logs or use their own technologies as described in their privacy notices. Browser settings let you manage cookies and block external requests, although this may affect website features or appearance.

Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No internet transmission or storage system is completely secure.

We retain information for as long as reasonably needed for the purposes described above, including legal, record-keeping and dispute-resolution requirements. When it is no longer needed and retention is not required by law, we take reasonable steps to delete or de-identify it. Retention periods may vary between enquiry records, email, logs and backups.

Access, correction and privacy complaints

To request access to or correction of your personal information, ask about its handling, or make a privacy complaint, email support@starktrace.com. Describe your request without including unnecessary sensitive information. We may need to verify your identity before providing access or making changes, and legal exceptions may apply.

We will consider privacy requests and complaints and respond within a reasonable period, or any period required by law. If you are dissatisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC), which can advise whether it can consider your complaint.

11. Changes and applicable law

We may update these terms by publishing a revised version on this page with a new last-updated date. Changes apply to website use after publication and do not retrospectively affect accrued rights or change a separate agreement.

These terms are governed by the applicable laws of Australia. Nothing in these terms removes any mandatory protection or right to bring a claim in a court or tribunal available to you under applicable law. If a provision is unenforceable, the remaining provisions continue to apply to the extent possible.
